INVOICE LEGAL TERMS
In addition to the services above, our DJ Services always include:
-Beat Box Entertainment, Beat Box DJ Pros, LLC and Beat Box Entertainment, LLC are one in the same for this contract
-If paying by Credit Card, please add 3% processing fee!
The CLIENT agrees: • -Beat Box Entertainment and Beat Box DJ Pros, LLC are one in the same for this Contract • to pay a 50% deposit by within 30 days to reserve Beat Box, with remaining balance due 30 days before event date. If final payment is not made within 30 day of event, BB has the option to issue a refund of deposit and cancel this contract • Payments can be made by check, CashApp, Venmo, or Paypal. A 3% fee will be added to credit card payments (through Paypal). • that changes to conditions herein require a new contractual agreement. • contract can be cancelled with written notice. • the deposit is non-refundable, as Beat Box will immediately block-off this date and begin preparation. We will not issue refunds due to COVID-019, but we will offer to DJ/Photograph your wedding on another date which we are available. • Deposit is transferable to another date for which Beat Box is available. • to allow Beat Box to use pictures or videos from the event for our marketing, social media and website. • to provide a vendor meal to the DJ/MC/Photographer/PB attendant or allow he/she the opportunity to go through a buffet if provided as part of the event. • should we experience equipment failure that is not a result of client/venue/vendor interference or an Act of God, client is agreed to a maximum refund of the full amount paid to Beat Box for services. • should client feel they are entitled to a refund for any situation not related to the situations listed above, the maximum refund issued would be the amount paid to Beat Box for services. • contract is binding upon CLIENT signature AND receipt of deposit funds in Beat Box bank account. • the definition of performance, costs and services are understood & agreed upon by what is listed above in package. Beat Box agrees: • If our listed DJ/MC/Photographer is unable to perform for any reason, Beat Box will provide a replacement upon the CLIENT’S prior approval or issue a refund of the full amount listed above. • Contract can be cancelled with written notice. If cancelled inside of 3 months, we will refer you to another DJ/MC service, but cannot guarantee their availability. Any cancellation on the part of Beat Box will result in full refund of any payments made. • to render our professional services by the mutual promises contained herein. • to provide all services agreed upon during planning, such as music selection & announcements. • to arrive a minimum of 3 hours early, test setup, be fully prepared and have accessible backup equipment. • to provide musical entertainment by means of a recorded music format. • to respond to all CLIENT requests in a timely manner. • all our setup time, relevant equipment (noted more below), taxes, insurance & expenses are captured in the contracted amount for this designated package. This includes buying any requested music we may not already have. Changes to packages/services may change contract amount.
GENERAL CONTRACT NOTES REGARDING OUR SERVICES: • For any services not being performed, the CLIENT can add additional services (Ceremony/Uplighting/Image Projection) at any time based on availability. • It has never happened, but we need to point out that if any guests spill drinks on our equipment, or knock over the equipment, there will be a delay in services for us to resolve. We always carry backup equipment, and again, this has never happened, but we want to address. • We have (2) wireless mics for announcements and toasts. Should both of those become damaged or stop working due to wireless interference in the building/area, we carry a corded microphone as backup. If a guest drops a mic, the CLIENT will be responsible for replacement. • Our dance floor lighting blinks to the beat of the music and thus changes speeds. We cannot be responsible for anyone adversely affected by the colors or blinking pace of these lights. Should anyone ever have an issue with them, just inform us and we will shut off any necessary. This has also been a very rare occurrence. • We will provide our own table and black tablecloth. • The only break we take during weddings/events is while food is served, and only if food is part of the event, such as at a wedding. We will take 15 minutes to eat, but continue to have music playing.
Uplighting: • Our standard Uplights have cords that provide their power. They are not wireless/battery-operated. We make every attempt to hide and/or neatly tape down any cords. Uplights are most commonly used around the perimeter of a room to light “up” the walls or columns. As such, we run the power cords along the base of the walls to nearby power outlets. We tape down where necessary for neatness and safety, and hide cords as best as possible. Corded Uplights are the more common form of Uplights. Wireless Uplights are available, but are more expensive and less reliable for color brightness and duration. Wireless Uplights are not guaranteed unless specifically requested. If not requested, we will use Wireless Uplights are our discretion based on what is best suited for power availability and safe light placement.
Photo Booth : • Our default Photo Booth time of service is 4 hours during the Reception, unless noted otherwise. In most cases, the Photo Booth is not used during Cocktail Hour as that is often in a separate area. If Cocktail Hour is in the same area, it will be in operation if falling in the designated 4 or 5-hour timeframe. • Our Photo Booth can sometimes experience a small delay in operation when paper or ink runs out. We monitor this before and during each event, but the paper & ink may run out in the middle of your event and require time to change it out. On average, it takes 10 minutes to make this change. Should this happen, there are no refunds offered for time missed to change paper & ink. • Should a guest cause any temporary or permanent damage to the Photo Booth, no refunds will be offered for the Photo Booth being out of operation. • This has never happened, but should our Photo Booth experience greater than 1 hour of total downtime, that is not a result of ink/paper changes or damage/issues from guests/venue personnel/outside interferences, you will receive a pro-rated refund for any missed time greater than the 1-hour. Again, this has never happened but we want to make our policy known. Like any mechanical equipment, we can't guarantee something won't become defective, but we can guarantee that if it does you'll get a refund. And as stated above, we have never experienced equipment failure greater than a few minutes. • If you'd like to provide a design/logo for your photo strips, you can do so. If not provided, we will list the name/date/venue in text at the bottom of the photo strip with our logo as a shaded background.
360 Photo Booth : • Client is responsible for choosing background music of their choice; they must specify starting point of song to be added to videos • Should a guest cause any temporary or permanent damage to the Photo Booth, no refunds will be offered for the Photo Booth being out of operation. • This has never happened, but should our Photo Booth experience greater than 1 hour of total downtime, you will receive a pro-rated refund for any missed time greater than the 1-hour. Again, this has never happened but we want to make our policy known. Like any mechanical equipment, we can't guarantee something won't become defective, but we can guarantee that if it does you'll get a refund. And as stated above, we have never experienced equipment failure greater than a few minutes. • If you'd like to provide a design/logo for your video and/or text, you can do so. If not provided, we will list the name/date/venue in text at the bottom of the video with our logo as a shaded background.
WEDDINGS: Wedding Rehearsal: • Our contract does not include us attending any rehearsals. Generally, it is not needed for us to be there unless you have several moving parts of your ceremony that require music beyond the traditional processionals and ceremony structure. Examples involve combining our services with live music, unique setups, lack of power supply, etc.
If you’d like us to attend the Rehearsal the day/evening prior, we can do so at a cost of $200 to cover time & equipment necessary. We would also need to schedule this in advance to ensure no conflicts with other events the day prior. Wedding Ceremony: • If your videographer or anyone else is using wireless systems, it could create microphone interference. We do all we can to test for this beforehand to lessen the chance of this happening. But in the event it does happen, we cannot be held responsible for other systems causing interference. Videographer mics, Venue systems and Police/Fire systems are examples of frequencies that can cause interference. In such cases, we bring down our mics, as cutting in/out can be more of a distraction. We also talk with the officiant beforehand about how to handle, resulting in them speaking louder should such a situation ever occur. This is a rare occurrence, but we wanted to address. • Our standard ceremony setup is 1 lapel mic for the officiant and 1 handheld mic on a stand for readers. We can do 2 lapel mics or 2 handheld mics instead of 1/1 if needed. Should you need more than 2 total mics for your ceremony, we can do that but there is an additional cost to cover setup time & equipment needed. • Please be aware for outdoor ceremonies, wind can make it difficult for a person to be heard at times. We have windscreens for our mics, but in some cases the mics must be brought down if the sound of the wind becomes too strong & is a distraction. • There must be power access within 150 feet. If there is not power access, we can provide a Generator at an additional cost of $300. This is a rare occurrence. • The ceremony location must be on the same grounds and within a 5-10 minute ride to the cocktail hour/reception location. If it is not accessible by car, there must be a cart provided for us to transport equipment, etc. • We will need a Tent for Outdoor Ceremonies to protect our equipment (and your ceremony) from the elements (rain, sun, heat, etc.). We provide our own tent. Should you not want us to use a tent, we will discuss the risks associated with that during planning. Wedding Cocktail Hour: • There will be a few minutes delay prior to the start of your cocktail hour music. Once the ceremony ends and everyone has exited toward Cocktail Hour, we will head over there and turn on the music. It’s only a few minutes delay obviously but we like to make that known.
IMAGE PROJECTION: Image projection visibility can vary depending on surface projected on and the brightness of the room. If we cannot get your image to project properly because of this, Client is not entitled to a refund. Please verify that the image will project before the day of the wedding. If we cannot get the image to project because of a malfunction with our equipment, Client is entitled to a refund of image projection free.
PHOTOGRAPHY: Client agrees to provide a meal for Photographer if Photographer’s attendance is required for greater than five (5) hours. Client agrees to give/have someone give Photographer sufficient warning of key events at the wedding to give the Photographer time to prepare (i.e., bouquet toss, cake cutting, speeches, etc.) Photographer will endeavor to get photographs of as many guests as possible, which may be limited by guests’ cooperation in having their photo taken. Client agrees that Photographer shall be given precedence in taking photographs over guests with cell phone cameras and other devices. Photographer cannot be held responsible for lack or photographs or poor quality of photographs if guests are interfering with Photographer’s work. Client acknowledges Photographer may be limited in scope by rules of the location of the ceremony and/or reception. (i.e., flash photography may not be allowed within a Church). Copyright. Photographer shall maintain the copyright of all photographs. Photographer grants Client permission to make copies of the images for personal use by Client and their family and friends. Sale, publication, or any other commercial use is specifically prohibited without the prior written consent of Photographer. Cancellation. By Client. Client may cancel this Agreement at any time prior to the event. Upon cancellation, Client will be entitled to a refund of any monies paid, except for the non-refundable deposit. By Photographer. Photographer may cancel this Agreement at any time. If Photographer cancels, it must provide a suitable, replacement Photographer, subject to Client’s approval, which shall be obtained in writing. In the alternative, Photographer shall refund all monies previously paid by Client, including the non-refundable deposit. Dispute Resolution and Legal Fees. In the event of a dispute arising out of this Contract that cannot be resolved by mutual agreement, the Parties agree to engage in mediation. If the matter cannot be resolved through mediation, and legal action ensues, the successful party will be entitled to its legal fees, including, but not limited to its attorneys’ fees. Severability. In the event any provision of this Agreement is deemed invalid or unenforceable, in whole or in part, that part shall be severed from the remainder of the Agreement and all other provisions should continue in full force and effect as valid and enforceable. Legal and Binding Agreement.This Agreement is legal and binding between the Parties as stated above. This Agreement may be entered into and is legal and binding both in the United States and throughout Europe. The Parties each represent that they have the authority to enter into this Agreement. Governing Law and Jurisdiction. The Parties agree that this Agreement shall be governed by the State and/or Country in which both Parties reside/do business. In the event that the Parties do business in different States and/or Countries, this Agreement shall be governed by South Carolina law. Entire Agreement. The Parties acknowledge and agree that this Agreement represents the entire agreement between the Parties. In the event that the Parties desire to change, add, or otherwise modify any terms, they shall do so in writing to be signed by both parties.
